You agree to indemnify and hold NAD, its affiliates, agents, suppliers directors, officers, employees and other personnel harmless from all liabilities, losses, damages or expenses related to or arising from your or any user of your Account or Services, or any breach of the terms and conditions of this Agreement or any violation of any NAD rules, policies or applicable law.
10. Performance Levels
Transmission speed is a function of the capacities and bottlenecks experienced upon the wider network architecture of the Internet itself as well as the geographic environment in which a wireless internet zone may be deployed. NAD does not guarantee any level of performance of the Services.
11. Security and Privacy
NAD will not be responsible for any corrupted files, spyware, malware, or viruses, or any other malicious code which affects any user of the Services. It is your responsibility to safeguard your systems, including any hardware, software, data and information contained therein, through appropriate means (e.g., using commercially available software), from theft, unauthorized use or system corruption. Account and password protection shall be your responsibility. Any harm or damage caused to NAD’s network as a result of your failure to properly secure your system may result in the immediate termination of your service and your account. NAD cannot ensure or guarantee privacy for users of the Services. Your messages may be the subject of unauthorized third party interception and review. It is therefore recommended that the Services not be used for the transmission of confidential information. Any such use shall be at your sole risk. You acknowledge that wireless internet zones represent additional security risks as compared with wired internet connections, and that wireless internet zones do not provide any level of encryption.
12. IP Address / Host Name
Any IP address assigned to you by NAD is the property of NAD at all times. IP addresses may change each time you access a wireless internet zone, or any time at the discretion of NAD without prior notice to you.
User Obligations. An individual with Internet access can cause damage, incur expenses and enter into contractual obligations while on the Internet. All such matters are solely your responsibility. NAD and has no obligation to monitor the Service. However, you agree that NAD reserves the right to monitor the Service electronically from time to time and to disclose any information necessary to conform with any and all applicable laws, regulations or other governmental request or as necessary to operate the Service or to protect itself or others.
13. User Obligations
An individual with internet access can cause damage, incur expenses and enter into contractual obligations while on the internet. All such matters are solely your responsibility. NAD and has no obligation to monitor the Services. However, you agree that NAD reserves the right to monitor the Services electronically from time to time and to disclose any information necessary to conform with any and all applicable laws, regulations or other governmental request or as necessary to operate the Services or to protect itself or others.

Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), or otherwise, (even if NAD, its suppliers or its agents, directors, officers, employees or other personnel have been advised of the possibility of such damages). Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the Services, from inability to use the Services, or from the interruption, suspension, or termination of the Services (including such damages incurred by third parties). This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on the Services or received through any links provided in the service, as well as by reason of any information or advice received through or advertised on the Services or received through any links provided in the Services. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data. This Agreement may be terminated by you upon notice to NAD. NAD may suspend or restrict the Service, at any time without notice, or terminate this Agreement, including the Service, at any time for any reason, including without limitation, if: (i) the operations or efficiency of the Service is impaired by the use of your Account or the Service; or (ii) you have breached any term or condition of this Agreement. Any termination of this Agreement shall not relieve you from any amounts owing or other liability accruing hereunder prior to the time that such termination becomes effective.
18. Homepage Redirection
While you use this Service, the Service will redirect your equipment to our website in place of your normal homepage. This redirection is only in effect while you are using the Service, and is not a permanent change. Your chosen homepage should be restored when you access the Internet through an alternate provider.
19. Rights of Assignment
NAD may assign its rights and obligations under this Agreement without your prior written consent. You may not assign or transfer this Agreement.
20. Force Majeure
In no event shall NAD be liable for any failure to comply with this Agreement if such failure results from any condition or event beyond the reasonable control of NAD, including, but not limited to, fire, flood, earthquake, any elements of nature or acts of God, theft, riot, strike or other labour disturbance, power failure, war or terrorism or any threat thereof.
21. Entire Agreement
These Terms and Conditions represent the entire understanding relating to the use of the Website and supersede all other statements, representations or warranties (whether written, made electronically or orally) made by us. Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty or condition that was made fraudulently. Any rights not expressly granted in these Terms and Conditions are reserved by us.
